First Appellate Authority under the Right to Information Act, 2005
Under the Right to Information Act, 2005, a citizen has the right to approach the First Appellate Authority (FAA) if the information requested through an RTI application is not received within the prescribed time limit, or if the information provided is incomplete, incorrect, or unsatisfactory.
Major Responsibilities of the First Appellate Authority
The First Appellate Authority is responsible for examining appeals filed against the decisions or actions of the Public Information Officer (PIO). The major responsibilities include:
Considering complaints and appeals related to RTI applications.
Examining whether the Public Information Officer has failed to provide the requested information.
Verifying the completeness and legality of the information provided.
Seeking clarification or explanation from the Public Information Officer, wherever necessary.
Directing the concerned Public Information Officer to provide information in accordance with the provisions of the Act.
Examining whether the reasons given for denying information are legally valid.
Examining the relevant records and facts associated with the appeal and issuing an appropriate order.
Situations in Which a First Appeal May Be Filed
A First Appeal may be filed under the following circumstances:
When no response is received from the Public Information Officer within 30 days of submitting the RTI application.
When the information provided is incomplete or incorrect.
When the Public Information Officer refuses to provide the requested information.
When there is an undue delay in providing information that is required to be furnished under the Act.
When the applicant is not satisfied with the decision taken by the Public Information Officer regarding the requested information.
Time Limit for Filing an Appeal
Generally, a First Appeal may be filed within 30 days from the date of receipt of the decision or response from the Public Information Officer. Where there are sufficient and reasonable grounds for the delay, the appellate authority may consider an appeal submitted after the prescribed period, in accordance with the applicable provisions.
